  • fraud prevention;

  • legal claims;

  • regulatory enquiries; and

  • compliance with lawful requests.

Our lawful basis will normally be compliance with a legal obligation. In some cases, we may also rely on our legitimate interests in establishing, exercising or defending legal claims.

Our use of cookies and analytics is explained in sections 11 to 16 below.

Marketing

We may use contact details and marketing preferences to send information about Clubhouse Heritage products, collections, offers and campaigns where permitted by law.

Depending on the circumstances, we may rely on:

  • your consent; or

  • the existing-customer exception commonly known as the soft opt-in, where its requirements are met.

Our marketing practices are explained in sections 17 to 25 below.

Personalised advertising

Where required consent has been obtained, we may use information about website visits and campaign interactions to provide, measure or improve advertising.

  • the permission you have provided;

  • our legitimate interests where appropriate; or

  • another lawful basis explained when the information is collected.

Where required, we will obtain appropriate permission before using identifiable customer content in our advertising.

6. Our legitimate interests

Where we rely on legitimate interests, those interests may include:

  • operating and improving our online shop;

  • providing customer support;

  • promoting similar Clubhouse Heritage products where legally permitted;

  • understanding customer preferences;

  • preventing fraud and misuse;

  • securing our website and systems;

  • managing complaints and disputes;

  • protecting our legal rights.

Before relying on legitimate interests, we consider whether the processing is necessary and whether your rights and interests override ours.

You may object to certain processing carried out on the basis of legitimate interests.

You have an unconditional right to object to the processing of your personal information for direct-marketing purposes.

7. Who we share information with

We may share personal information with organisations that help us operate Clubhouse Heritage, including:

  • Shopify and other ecommerce or website providers;

  • payment processors and banks;

  • fraud-prevention and security providers;

  • warehouse and fulfilment providers;

  • packaging and logistics providers;

  • postal and courier companies;

  • email and communication providers;

  • customer-service providers;

  • analytics and website-performance providers;

  • advertising and social-media platforms;

  • review and survey providers;

  • IT, security and data-storage providers;

  • accountants;

  • solicitors and other professional advisers;

  • insurers;

  • regulators, law-enforcement bodies, courts and public authorities; and

  • prospective buyers, investors or advisers in connection with a sale, restructure or transfer of our business.

Providers acting on our behalf may only use information for the services they have been engaged to provide, subject to appropriate contractual and security requirements.

We may also share information where:

  • you have asked or authorised us to do so;

  • it is necessary to fulfil an order;

  • the law requires or permits it;

  • it is required to protect someone's rights, property or safety; or

  • it is necessary to establish, exercise or defend legal claims.

We do not sell your personal information.

8. International transfers

Some of our ecommerce, technology, payment, analytics, advertising and service providers may process information outside the United Kingdom.

Where personal information is transferred internationally, we will use an appropriate legal safeguard where required.

This may include:

  • transferring information to a country covered by UK adequacy regulations;

  • using the UK International Data Transfer Agreement;

  • using the UK Addendum to approved Standard Contractual Clauses; or

  • relying on another lawful transfer mechanism.

Where appropriate, we may also carry out checks on the protections offered by the recipient and destination country.

You can contact us for more information about safeguards relevant to your information.

9. How long we keep information

We retain information only for as long as reasonably necessary for the purpose for which it was collected, including legal, accounting, regulatory, fraud-prevention and reporting requirements.

Generally:

  • order, payment, refund, tax and accounting records may be retained for approximately six years or longer where legally required;

  • account information is normally retained while an account remains active and for a reasonable period afterwards;

  • customer-service and complaint records may be retained for up to six years where necessary to deal with disputes and legal claims;

  • competition information is retained for the period required to administer the promotion and meet legal or accounting requirements;

  • marketing information may be retained while you remain subscribed or while we may lawfully market to you;

  • suppression information may be retained after you opt out so that we can continue to respect that choice;

  • fraud and security information is retained for as long as reasonably necessary to prevent or investigate misuse; and

  • cookie and tracking information is retained for the applicable periods associated with those technologies.

We may retain information for longer where a complaint, legal claim, regulatory investigation or suspected fraud is ongoing.

When information is no longer required, we will delete, anonymise or securely destroy it.

COOKIES AND SIMILAR TECHNOLOGIES

10. What are cookies?

Cookies are small text files or pieces of information stored on your computer, mobile phone, tablet or other device when you visit a website.

We may also use related technologies such as pixels, tags, local storage and similar tools.

These technologies can help a website:

  • operate correctly;

  • remember your choices;

  • keep products in your basket;

  • maintain security;

  • understand how the website is being used;

  • measure performance; and

  • support advertising and marketing where permitted.

Some technologies are necessary for our website to function. Others are optional or may require your consent.

11. Strictly necessary technologies

Certain cookies and similar technologies are required for our website and online shop to work properly.

They may be used for purposes including:

  • maintaining your shopping basket;

  • enabling checkout;

  • processing transactions;

  • security;

  • fraud prevention;

  • authentication;

  • remembering privacy choices;

  • maintaining sessions;

  • providing requested account features; and

  • ensuring that the website operates correctly.

Where a technology is strictly necessary to provide a service you have requested, your consent is not required for that technology.

12. Shopify cookies and reporting

Our online shop is hosted by Shopify.

Shopify provides technology required to operate our website, basket and checkout and also provides reporting and analytics that help us understand the performance of our store.

Shopify may place cookies and use similar technologies in connection with these services.

Depending on the Shopify services being used, these may include cookies such as:

  • _landing_page, which can help identify the page through which a visitor reached the website;

  • _orig_referrer, which can help identify where visitors came from;

  • _shopify_s, which can distinguish a particular browser session;

  • _shopify_y, which supports Shopify analytics;

  • _shopify_analytics, which may contain analytics information relating to storefront or checkout activity; and

  • other Shopify security, privacy, checkout, localisation or functionality cookies.

Shopify may change the cookies and technologies it uses as its services develop.

Some Shopify technologies are necessary for our store to function. Others may relate to reporting, analytics or marketing and will be treated according to their purpose and applicable legal requirements.

13. Google Analytics

We use Google Analytics 4 (GA4) to help us understand how visitors use the Clubhouse Heritage website.

Depending on our configuration, Google Analytics may provide information such as:

  • website visitor numbers;

  • pages viewed;

  • time spent on pages;

  • website journeys;

  • referring sources;

  • device and browser information;

  • approximate geographic information;

  • website interactions; and

  • ecommerce or conversion information where configured.

Google Analytics may use cookies including:

  • _ga; and

  • cookies beginning _ga_.

These cookies may be used to distinguish visitors and maintain information relating to website sessions.

Where our use of Google Analytics or another analytics service falls outside an applicable statistical-purpose exception, we will treat it as optional and obtain any consent required before activating it.

Where an analytics technology is used solely to generate aggregate statistical information for improving our website and meets the requirements of an applicable legal exception, it may be used without prior cookie consent. Where required, we will provide clear information about that use and an easy way to object.

Analytics information will not be treated as exempt statistical analytics where it is also being used for purposes such as individual tracking, profiling, advertising or sharing conversions with advertising providers where consent is required.

14. Marketing and advertising technologies

Where you have provided the relevant consent, we may use cookies, pixels and similar technologies to support marketing and advertising.

These technologies may help us:

  • measure advertising performance;

  • understand whether an advertisement resulted in a website visit or purchase;

  • show advertising that is more relevant to you;

  • limit how often you see a particular advertisement;

  • understand interactions with marketing campaigns; and

  • create or reach relevant advertising audiences through advertising or social-media platforms.

These technologies may involve information about your interaction with our website being shared with relevant advertising or social-media service providers.

Where consent is legally required, marketing and advertising technologies will not be activated unless you have made the relevant choice through our cookie-control tool.

You can change or withdraw this choice through our cookie settings.

15. Cookie duration

Cookies may be either session cookies or persistent cookies.

Session cookies normally expire when you close your browser or after a period of inactivity.

Persistent cookies remain on your device until they expire or are deleted.

The duration depends on the individual technology.

For example, Shopify currently identifies some analytics cookies as lasting approximately:

  • 30 minutes for _shopify_s;

  • two weeks for _landing_page;

  • two weeks for _orig_referrer; and

  • one year for certain Shopify analytics cookies.

These periods may change where Shopify or another service provider updates its technology.

Your browser may also allow you to delete cookies before they expire.

16. Managing your cookie preferences

Where applicable, our website provides a cookie-control tool that allows you to manage optional cookies and similar technologies.

You may be able to:

  • accept optional technologies;

  • reject optional technologies;

  • select particular categories; and

  • change your preferences later.

You can also manage cookies through your browser settings.

Blocking some technologies may affect the functionality or experience of our website.

Strictly necessary technologies cannot normally be disabled through our cookie preferences because they are required to provide the website or service you request.

Where we rely on an applicable statistical or functionality exception rather than consent, we will provide the information and objection mechanism required by law.

MARKETING PREFERENCES AND CONSENT

17. What we mean by marketing

Marketing communications may include:

  • information about new products and collections;

  • early-access opportunities;

  • special offers and discount codes;

  • competitions and prize draws;

  • seasonal campaigns;

  • abandoned-basket reminders;

  • Clubhouse Heritage news and content;

  • requests for reviews or feedback where the communication also promotes our products; and

  • personalised or targeted advertising.

Order confirmations, payment receipts, delivery updates, product-safety notices, changes to our terms and responses to customer enquiries are normally service communications rather than marketing.

You may therefore continue to receive necessary service communications even if you have opted out of marketing.

18. How we obtain marketing consent

Where consent is required, we will ask you to take a clear and positive action, such as ticking an unticked box or submitting a marketing sign-up form.

We will not:

  • use pre-ticked consent boxes;

  • hide marketing consent within our general terms;

  • make marketing consent a condition of buying a product where it is not necessary;

  • treat silence or inactivity as consent; or

  • assume that entering a competition automatically means you have agreed to unrelated marketing.

Where we ask for consent, our wording will aim to explain:

  • that the marketing is from Clubhouse Heritage;

  • the type of communications you may receive;

  • the relevant communication method, such as email or text; and

  • how you can withdraw your consent.

Where we offer more than one marketing channel, we may allow you to select your preferences separately.

19. Email and text marketing

We may send marketing by email or text where:

  • you have provided valid consent; or

  • the products-and-services soft opt-in applies.

The soft opt-in may allow us to contact you about our own similar products where:

  • we obtained your contact details directly from you;

  • we obtained them during a sale or genuine negotiation about a possible sale of a product or service;

  • the marketing relates to our own similar products;

  • you were given a clear opportunity to opt out when your details were collected; and

  • every subsequent marketing message provides a simple opportunity to opt out.

Where we rely on the soft opt-in, our data-protection lawful basis will normally be our legitimate interests in promoting similar Clubhouse Heritage products.

We will not rely on the soft opt-in to promote unrelated third-party products.

20. Competitions and prize draws

Entering a Clubhouse Heritage competition or prize draw does not automatically subscribe you to general marketing.

Where we would like to send marketing to competition entrants, we will provide a separate marketing choice where required.

You will not normally need to agree to unrelated marketing in order to enter a competition.

Where a promotion asks entrants to share or tag Clubhouse Heritage on social media, the relevant competition terms may explain:

  • how to enter;

  • the closing date;

  • eligibility requirements;

  • how a winner will be selected;

  • how a winner will be contacted; and

  • whether submitted content may be shared by Clubhouse Heritage.

Permission to share a competition entry or social-media post does not automatically amount to consent to receive email or text marketing.

21. Social-media and personalised advertising

Where you have accepted the relevant cookies or tracking technologies, we may use information about visits to our website to:

  • measure advertising performance;

  • understand whether an advertisement resulted in a visit or purchase;

  • show advertising that is more relevant to you;

  • limit advertising frequency; and

  • create or reach relevant audiences through advertising or social-media platforms.

You can manage relevant activities using our cookie settings and, where applicable, through the advertising and privacy settings made available by the relevant platform.

Where legally required, advertising and tracking technologies will not be activated before the relevant consent has been provided.

If you object to the processing of your personal information for direct-marketing purposes, we will stop processing that personal information for those purposes where the right applies.

22. Third-party marketing

We do not sell your personal information.

We will not provide your contact details to another organisation so that it can send its own marketing to you unless we have a valid legal basis to do so and have obtained any consent required by law.

Where consent is required, we will provide appropriate information about the organisation or organisations involved and the type of marketing you may receive.

We may use service providers to send Clubhouse Heritage marketing on our behalf.

Where they act as our processors, they must act in accordance with our instructions and appropriate contractual requirements and must not use your information for their own unrelated marketing.

23. Withdrawing consent and opting out

You can withdraw marketing consent or object to direct marketing at any time.

You may do this by:

  • using the unsubscribe link in a marketing email;

  • following the opt-out instructions in a text message;

  • changing account or communication preferences where available;

  • changing advertising or cookie preferences; or

  • emailing contact@theclubhouseheritage.co.uk.

Withdrawing consent does not affect the lawfulness of processing carried out before consent was withdrawn.

We will process opt-out requests as soon as reasonably possible.

You may occasionally receive a communication that was already being processed at the time your opt-out was recorded, but we will not intentionally begin sending new marketing to you after your opt-out has taken effect.

24. Suppression records

When you unsubscribe or object to direct marketing, we may retain limited information such as your email address, telephone number and opt-out status on a suppression record.

This allows us to remember and respect your choice and helps prevent you from being accidentally added back to marketing.

Keeping this limited information does not mean that we will continue sending marketing to you.

25. Marketing records and duration

We may keep records of:

  • when and how marketing consent was obtained;

  • the wording shown when consent was given;

  • the channel or channels selected;

  • changes to your preferences;

  • when you unsubscribed or objected; and

  • the source of the marketing information.

Marketing consent does not necessarily expire after a fixed period.

However, we will keep marketing practices and consent records under review.

We may stop relying on existing consent where:

  • it is no longer sufficiently clear or specific;

  • our marketing activities have materially changed;

  • we cannot demonstrate when or how consent was obtained; or

  • continuing to rely on the consent would no longer be appropriate.

Where appropriate, we may ask you to refresh your marketing preferences.

YOUR RIGHTS AND OUR RESPONSIBILITIES

26. Your data protection rights

Depending on the circumstances, you may have the following rights.

Access

You may ask whether we hold personal information about you and request a copy of it.

Correction

You may ask us to correct inaccurate information or complete information that is incomplete.

Erasure

You may ask us to delete personal information where there is no valid reason for us to continue holding it.

This right does not always apply, including where information must be retained for legal, tax, fraud-prevention or legal-claims purposes.

Restriction

You may ask us to restrict how we use your information in certain circumstances.

Objection

You may object to certain processing based on legitimate interests.

You have an unconditional right to object to the processing of your personal information for direct-marketing purposes.

Data portability

Where the legal requirements apply, you may request certain information in a structured, commonly used and machine-readable format or ask us to transfer it to another organisation.

Withdrawal of consent

Where we rely on consent, you may withdraw that consent at any time.

Withdrawal does not affect processing that took place before consent was withdrawn.

Automated decision-making

You may have rights in relation to certain decisions made solely through automated processing that have legal or similarly significant effects.

We do not currently expect to make solely automated decisions about customers that produce legal or similarly significant effects.

Fraud-detection systems may flag transactions for rejection or further review. Where required, we will provide appropriate safeguards and human involvement.

27. Exercising your rights

To exercise a data protection right, contact:

contact@theclubhouseheritage.co.uk

Please explain:

  • which right you wish to exercise;

  • the information or account concerned; and

  • any details that may help us locate the relevant information.

We may request information reasonably necessary to confirm your identity.

We will not request more information than is reasonably necessary for this purpose.

There is normally no charge for exercising a data protection right.

However, the law may allow us to charge a reasonable fee or decline to act in limited circumstances, such as where a request is manifestly unfounded or excessive.

We will respond within the timeframe required by applicable data protection law.

Where the law permits additional time for a complex request, we will inform you.

28. Complaints

If you are concerned about how we have handled your personal information, cookies or marketing preferences, please contact:

contact@theclubhouseheritage.co.uk

Where relevant, please include:

  • your name and contact details;

  • a description of your concern;

  • relevant dates;

  • order numbers or correspondence;

  • supporting information; and

  • the outcome you are seeking.

In accordance with our Complaints Policy and customer-service commitment, we aim to acknowledge complaints by email within 24 hours.

We will investigate appropriately, make relevant enquiries and explain the outcome.

You also have the right to raise a data-protection concern with the Information Commissioner's Office (ICO), the UK's independent data protection regulator.

We would appreciate the opportunity to address your concern first, but you are not required to contact us before approaching the ICO.

29. Keeping your information secure

We use appropriate technical and organisational measures designed to protect personal information against:

  • unauthorised access;

  • unlawful use or disclosure;

  • accidental loss;

  • destruction;

  • damage; and

  • alteration.

These measures may include:

  • access controls;

  • password and account-security measures;

  • encryption where appropriate;

  • secure payment processing;

  • supplier and staff confidentiality requirements;

  • system monitoring;

  • backups;

  • supplier checks; and

  • incident-response procedures.

No website or electronic transmission can be guaranteed to be completely secure.

You are responsible for keeping account passwords confidential and should contact us promptly if you believe your account has been compromised.

30. Personal-data breaches

Where we become aware of a personal-data breach, we will investigate and take appropriate steps to contain and address it.

Where legally required, we will notify the Information Commissioner's Office and affected individuals within applicable timescales.

31. Children's information

Our website and marketing are not specifically directed at young children.

We do not knowingly collect personal information directly from children under 13 through services that require their own consent.

If we become aware that this has occurred without appropriate authorisation, we will take reasonable steps to remove the information where required.

A parent or guardian who believes a child has provided personal information to us can contact:

contact@theclubhouseheritage.co.uk

32. Third-party websites and platforms

Our website may contain links to third-party websites, payment services or social-media platforms.

Those organisations operate under their own privacy practices and policies.

We are not responsible for how an independent third party handles personal information once you leave our website or interact directly with that third party.

We recommend reviewing the privacy information provided by the relevant third party.

33. Changes to this policy

We may update this policy from time to time to reflect:

  • changes to our website or services;

  • new suppliers or technologies;

  • changes to cookies or analytics;

  • changes to our marketing activities;

  • operational changes; or

  • changes to legal or regulatory requirements.

The latest version will be published on our website and the date at the top of this policy will show when it was last updated.

Where a change is significant, we may also bring it to your attention by email, through your account or by a prominent notice on our website.
