TERMS AND CONDITIONS OF SALE

Last updated: August 2026

1. About us

These Terms and Conditions apply to purchases made through [WEBSITE ADDRESS].

The website and Clubhouse Heritage brand are operated by THE CLUBHOUSE HERITAGE LTD, trading as Clubhouse Heritage.

Our company details are:

  • Company name: THE CLUBHOUSE HERITAGE LTD
  • Company number: 17168263
  • Registered in: England and Wales
  • Registered office: The Stables, Summer Road, Walsham-Le-Willows, IP31 3AJ
  • Customer service email: info@theclubhouseheritage.co.uk

In these Terms, “we”, “us” and “our” refer to THE CLUBHOUSE HERITAGE LTD. “You” and “your” refer to the customer placing an order.

2. About these Terms

These Terms explain:

  • how you may place an order with us;
  • how a contract is formed;
  • payment and delivery arrangements;
  • your cancellation and return rights;
  • what happens if there is a problem with an item; and
  • our respective responsibilities.

Please read these Terms before placing an order. By placing an order, you confirm that you accept them.

Nothing in these Terms limits or removes any rights you have under UK consumer law.

3. Who may place an order

You must be legally capable of entering into a binding contract to place an order.

Where a person under the age of 18 places an order, they confirm that they have permission from a parent or legal guardian and are authorised to use the selected payment method.

Products purchased through our website are intended for personal and domestic use. Please contact us before placing an order for commercial resale.

4. Our products

We take reasonable care to ensure that product descriptions, photographs, colours, measurements and other information displayed on our website are accurate.

Colours may appear slightly different depending on your device, display settings and lighting. As garments may be produced using natural fibres or separate production batches, minor variations in colour, texture and finish may also occur.

These reasonable variations will not affect your statutory rights where an item is faulty, not as described or otherwise does not meet the standards required by law.

Product measurements are approximate. Please consult the relevant size guide before ordering.

5. Product availability

All products are subject to availability.

Adding an item to your basket does not reserve it. In the unlikely event that an item becomes unavailable after you have ordered, we will contact you and refund any amount you have paid for that item.

We may limit the quantity of products available to a single customer, household or order where reasonably necessary.

6. Prices

Product prices are displayed in pounds sterling.

Prices include VAT where VAT is applicable, unless clearly stated otherwise.

Delivery charges are shown separately before you complete your order.

We may change our prices at any time. Price changes will not affect an order that we have already accepted.

If a product is listed with an obvious pricing error, we may contact you before accepting the order and give you the choice of proceeding at the correct price or cancelling the order.

7. Placing an order

You are responsible for checking your order, delivery address and contact information before submitting it.

After placing an order, you will receive an order acknowledgement. This confirms that we have received your order but does not necessarily mean that we have accepted it.

A contract between you and us is formed when we send you a dispatch confirmation or otherwise confirm that your order has been accepted.

We may decline or cancel an order before acceptance where, for example:

  • a product is unavailable;
  • payment cannot be authorised;
  • there is an obvious pricing or product-description error;
  • delivery is not available to the address provided;
  • we reasonably suspect fraud or unauthorised activity; or
  • the order breaches a purchase limit or these Terms.

If we cancel an order after taking payment, we will refund the amount paid.

8. Payment

We accept the payment methods displayed at checkout.

Payment information is processed securely by our selected payment provider. We generally do not receive or store your full card details.

You confirm that:

  • you are authorised to use the payment method provided;
  • the information supplied is complete and accurate; and
  • sufficient funds or credit are available.

9. Discount codes and promotions

Discount codes:

  • must be entered before an order is completed;
  • cannot normally be applied retrospectively;
  • may be limited to particular products, customers or dates;
  • cannot be exchanged for cash;
  • may not be used with another offer unless stated otherwise; and
  • may be withdrawn or amended where reasonably necessary.

Separate terms may apply to competitions, prize draws, giveaways and promotional campaigns.

If we reasonably believe that a discount, promotion or referral arrangement has been misused, we may cancel the discount or affected order.

10. Delivery

We currently deliver within the United Kingdom & Ireland to the locations shown at checkout.

Available delivery methods, estimated timescales and charges will be displayed during checkout.

We will deliver your order by the estimated delivery date shown in your order confirmation. Where no date has been agreed, we will deliver without undue delay and normally within 7 days after accepting your order.

Delivery estimates are not guaranteed unless we expressly state that a delivery date is guaranteed.

You must provide a complete and accurate delivery address. Please contact us promptly if you notice an error. We cannot guarantee that an address can be changed once an order has entered the fulfilment process.

If delivery is delayed by circumstances outside our reasonable control, we will contact you as soon as reasonably possible and take steps to minimise the delay.

11. Responsibility for the products

We remain responsible for the products until they are delivered to:

  • you;
  • a person identified by you to receive them; or
  • a safe place or neighbour specifically authorised by you, where applicable.

Ownership of the products passes to you once we have received payment in full and the products have been delivered.

12. Cancelling an order before dispatch

Please contact us at contact@theclubhouseheritage.co.uk as soon as possible if you wish to cancel or amend an order.

We cannot guarantee that an order can be cancelled or amended once it has entered the fulfilment or dispatch process.

Where an order has already been dispatched, you may use your cancellation and return rights set out in our Refunds and Returns Policy.

13. Your right to cancel an online order

For most products purchased online, you have a legal right to change your mind and cancel the contract.

You normally have 14 days after the day on which you, or a person nominated by you, receives the products to tell us that you wish to cancel.

You then have a further 14 days to return the products.

Full details, including exclusions and return instructions, are contained in our Refunds and Returns Policy.

14. Faulty, damaged or incorrect products

We are under a legal duty to supply products that are:

  • of satisfactory quality; and
  • fit for their intended or agreed purpose

Please contact us promptly if an item is faulty, damaged, incorrect or not as described.

Your rights in relation to faulty goods are separate from your right to change your mind. Our Refunds and Returns Policy explains how to report a problem.

Nothing in these Terms affects your statutory rights.

15. Returns and refunds

Returns and refunds are handled in accordance with our Refunds and Returns Policy, which forms part of these Terms.

For returns, we ask that garments are returned:

  • unworn, other than being tried on as reasonably necessary;
  • unwashed;
  • clean and free from marks, scents, pet hair or other damage;
  • with their original labels and tags attached;
  • in their original packaging where reasonably possible; and
  • in a condition suitable for resale.

These conditions do not remove your statutory cancellation rights. However, we may reduce a refund where handling beyond what is reasonably necessary has diminished the value of an item.

16. Our responsibility to you

We are responsible for foreseeable loss or damage caused by our breach of these Terms or our failure to use reasonable care and skill.

Loss or damage is foreseeable where it was an obvious consequence of our breach or was contemplated by both you and us when the contract was formed.

We do not exclude or limit liability where it would be unlawful to do so, including liability for:

  • death or personal injury caused by negligence;
  • fraud or fraudulent misrepresentation;
  • breach of your statutory consumer rights; or
  • any other liability that cannot legally be excluded.

Products sold through our consumer website are intended for personal and domestic use. We are not responsible for business losses, loss of profits or loss of commercial opportunity resulting from use of products for business or resale purposes where that use was not agreed with us.

17. Events outside our reasonable control

We will not be responsible for delays or failure to perform our obligations caused by events outside our reasonable control.

These may include severe weather, transport disruption, industrial action, failures affecting carriers or service providers, natural disasters, government restrictions, civil emergencies or interruptions to communications networks.

We will take reasonable steps to reduce the effect of the event. Where a substantial delay occurs, you may contact us to discuss cancellation and a refund for products you have not received.

18. Intellectual property

All intellectual property rights in our website and its content, including the Clubhouse Heritage name, branding, logos, designs, text, photographs, videos and graphics, belong to us or our licensors.

You may use the website for personal, non-commercial shopping purposes only.

You must not reproduce, distribute, modify, sell, license or commercially exploit our content without our prior written permission.

19. Personal information

We process personal information in accordance with our Privacy Policy.

We use customer information to process orders, arrange delivery, provide customer service, prevent fraud, meet our legal obligations and, where permitted, send marketing communications.

20. Complaints

We want you to be happy with your Clubhouse Heritage experience.

Complaints should be sent to contact@theclubhouseheritage.co.uk. We will respond within 24 hours of receiving your email. This initial response may acknowledge your complaint and explain the next steps where a full resolution is not immediately possible.

Further details are contained in our Complaints Policy.

21. Changes to these Terms

We may update these Terms to reflect changes to our business, website, processes or applicable law.

The Terms applying to your purchase will be those displayed when you placed your order.

22. If part of these Terms is invalid

If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue in effect.

23. No waiver

If we do not immediately enforce a right under these Terms, this does not mean that we have waived that right.

24. Third-party rights

Unless expressly stated otherwise, no person other than you and us has the right to enforce these Terms.

25. Governing law

These Terms and any contract between you and us are governed by the laws of England and Wales.

If you live in Scotland or Northern Ireland, you will continue to benefit from any mandatory protections available under the laws applying in your home jurisdiction. You may bring legal proceedings in the courts of the part of the United Kingdom in which you live.
